We strive to deliver quality products as scheduled to all of our customers. However, we understand that occasionally the need to file a claim will arise. When filing a claim, please provide the following information:
This information will enable us to respond and resolve your claim in a timely manner. Please send all claims to Eric Scott Griffin at ericscottg@firmelements.com. Photos and a written report are required for all claims.
Quality Claims
Quality Claims must be filed with Firmelements LLC within 14 days of order receipt.
Shortage Claims
Shortages Claims must be filed in writing with Firmelements LLC within 24 hours of the receipt of your order. Photos are required for all claims. Credit(s) will not be issued for claims received over 24 hours after order receipt.
Transit Damage Claims
Transit damage MUST be noted when RECEIVING the order and noted on FedEx or Firmelements LLC paperwork. DO NOT discard shipment. Transport claims must be filed with the carrier by the customer within 48 hours of order receipt. DO NOT discard shipment. Without the damaged boxes or photos, carriers have the right to deny the claim.
Force Majeure
Firmelements LLC shall not be responsible or liable for any delays in service completion due to any cause or condition beyond its control, including but not limited to fire, flood, earthquake, labor dispute, shortage or materials or supplies, riot or other civil disobedience, war, acts of God or nature, accident, or any acts of any government.
Firmelements LLC stands by its products but because of environmental and planting and growing conditions beyond our control, FIRMELEMENTS LLC cannot guarantee the effectiveness of its products or guarantee the results of the use of its products(s) and shall not be liable for any damage or claims of damage that arise or are allege to arise out of the use of its products. Buyer’s remedy is limited to the purchase price of the product determined to be defective and covered by this limited warranty. Under no circumstances will FIRMELEMENTS LLC’s liability exceed the cost of the purchase price of the product determined to be defective and covered by this limited warranty.
THE LIMITED WARRANTY STATED ABOVE IS THE LIEU OF ALL OTHER WARRANTIES, EXPRESSED OR IMPLIED, AND FIRMELEMENTS LLC HEREBY DISCLAIMS ANY AND ALL OTHER WARRANTIES OF ANY KIND OR NATURE, INCLUDING WITHOUT LIMITATION ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR ANY PARTICULAR PURPOSE, OR FUTURE GROWTH. NO WARRANTIES OR REPRESENTATIONS MADE AT ANY TIME BY ANY REPRESENATITVE OF FIRMELEMENTS LLC SHALL BE EFFECTIVE TO VARY OR EXTEND THE LIMITED WARRANTY OR OTHER TERMS.
These terms and agreements shall be deemed made in San Luis Obispo County, State of California and shall be governed California law without regard to its conflict of laws principals.
